Reality TV Star Found not Guilty of Speeding in Scotland by Michael Lyon Solicitors, the Rta Experts

Firstly, we would like to take this opportunity to thank our client who provided full consent to post details of the case that was concluded in July 2008 at Dumbarton District Court.

As a young professional business woman, our client made some enquiry regarding Law Firms in Scotland that specialised in road traffic law. This was in the knowledge that a “not guilty” verdict was essential as any form of conviction would have resulted in the revocation of her driving licence. Following some initial telephone calls to various Firms, Michael Lyon Solicitors was instructed to defend the case.

Due to the New Driver Regulations, only an outright acquittal would preserve the licence. We seek to reserve comment regarding whether our client accepts that she was speeding. As we always emphasise, it is for the Crown to prove the charge beyond reasonable doubt. The interesting point about this case is that the Crown had served a certificate of accuracy in respect of the speed measurement device which had gone unchallenged.

This document should prove an essential fact of the Crown case, namely the accuracy of the technique used to measure the speed. Normal practice would be to challenge this document and force the Crown to prove this essential fact however our client was travelling about the UK to such an extent that the certificate had been served without her knowledge.

On the day of the trial, we had to advise our client that we were in trouble. Although, as many of our clients have discovered: nothing ventured, nothing gained and the case proceeded to trial. This was a remarkable result in light of the problem caused by the unchallenged certificate of accuracy.

So, how did we do it? It has nothing to do with basic points, for example type approval or identification. This was a “blood and guts” defence and only those truly experienced in road traffic law in Scotland would understand how a case that was essentially self-proving was deemed to lack evidence. For reasons that we consider obvious, we do not propose to reveal the more technical aspects of our defence strategies.

Anyway, in our case there will be no appeal.
